Breaking Ground in Memphis: A Partial Abatement Renews a Single-Family Home

…the C.R.G. Foundation was appointed as receiver to remedy nuisance conditions and code violations at a property. Partnering with a local nonprofit corporation known as N.P.I. (“Neighborhood Preservation, Inc.”), C.R.G.F. was able to successfully demonstrate the positive impact health and safety receiverships have on a neighborhood. As this was the first-ever partial abatement receivership within the state of Tennessee, the Foundation was excited to start this project and dedicate as much time and resources as necessary for a successful launch.
Upon inspection of the property, we recognized that this was going to be a challenging initial project.
The excessive mold growth alone meant that this property was an extremely hazardous environment. Clear evidence of pest infestation, as well as the presence of wild animals, was evident throughout the home. Every room was packed to the ceiling with hoarded and abandoned personal belongings covered in mold.An unmaintained exterior added to the dilapidated structural damage throughout the property. Overall, it was clear that this property needed help after being vacant and unmaintained for so long. The Foundation got to work right away after being appointed receiver by a judge.
Mold remediation and cleaning of the property turned out to be a relatively minor challenge during this receivership.
Nearly two weeks after an auction was held, and the court approved a buyer, a state of emergency was declared as coronavirus spread across the globe at an alarming rate. Needless to say, this caused quite a delay with legal actions required for the receivership to advance, as well as acquiring the necessary supplies to continue with construction. Despite the challenges the pandemic presented to the Foundation, with the help and patience of the buyer and N.P.I., we were able to continue with the receivership process.
Through the health and safety receivership remedy,
C.R.G. Foundation successfully abated the dangerous conditions at this nuisance property. The buyer followed the plan that C.R.G.F. and N.P.I. had put in place to complete the total rehabilitation of the house. Once the project was complete, this property once again became a wonderful single-family home. We proved that the Foundation can help a community take a nuisance property and turn it into a gem within the neighborhood through the receivership remedy.
